GDPR and Your Data Protection Rights

The General Data Protection Regulation (“GDPR”) is the principal European law governing how organisations collect and use personal data.

In Ireland, the GDPR operates alongside the Data Protection Act 2018 and is supervised by the Irish Data Protection Commission.

This page explains your principal rights and how you can exercise them with Auxilia Group.

Our Approach to Data Protection

When Auxilia Group processes personal data, we aim to ensure that it is:

  • used lawfully, fairly and transparently;
  • collected for clear and legitimate purposes;
  • limited to what is reasonably necessary;
  • accurate and kept up to date;
  • retained only for as long as required;
  • protected against unauthorised access, loss or misuse; and
  • handled in a way that demonstrates accountability.

Your Rights Under GDPR

Your rights depend on the circumstances and are subject to certain legal conditions and exemptions.

Right to Be Informed

You have the right to receive clear information about how and why your personal data is being used. This includes information about the organisation responsible, the purposes of processing, the legal basis, recipients and retention periods.

Right of Access

You may ask whether we process personal data about you and request a copy of that data. You may also request information about how the data is being used and who it has been shared with.

Right to Rectification

You may ask us to correct inaccurate personal data or complete information that is incomplete. Candidates and associates are encouraged to keep their CVs, professional profiles, contact information and availability up to date.

Right to Erasure

In certain circumstances, you may ask us to delete personal data. This may apply where the information is no longer required, you withdraw consent and no other legal basis applies, you successfully object to the processing, the information has been processed unlawfully or deletion is required by law.

Right to Restrict Processing

You may ask us to limit how personal data is used while a concern is being considered. For example, this may apply while we verify the accuracy of information or assess an objection.

Right to Data Portability

Where processing is based on consent or contract and is carried out by automated means, you may have the right to receive personal data you provided in a structured, commonly used and machine-readable format. Where technically feasible, you may also ask us to transmit that data to another organisation.

Right to Object

You may object to processing based on legitimate interests. We will consider the objection and stop processing unless there are compelling legitimate grounds to continue or the information is required for legal claims. You have an absolute right to object to the use of your personal data for direct marketing.

Right to Withdraw Consent

Where we rely on your consent, you may withdraw it at any time. Withdrawal will not affect processing that was lawfully carried out before consent was withdrawn.

Rights Relating to Automated Decisions

You may have the right not to be subject to a decision based solely on automated processing where that decision produces legal or similarly significant effects. Auxilia does not make significant recruitment or placement decisions solely through automated processing.

Erasure is not absolute

We may need to retain certain information to comply with legal obligations, maintain financial records, protect the rights of others or manage legal claims.

How to Make a Data Protection Request

Please use “Data Protection Request” in the email subject line and explain:

  • the right you wish to exercise;
  • the information or interaction concerned; and
  • any details that may help us locate the relevant records.

You do not need to use a particular form or legal wording.

Identity Verification

We may request reasonable additional information to confirm your identity before disclosing or changing personal data.

This is intended to prevent information from being provided to an unauthorised person. We will request only the information reasonably necessary for verification.

Response Times and Fees

We will normally respond within one month of receiving a valid request.

Where a request is particularly complex or numerous requests have been made, this period may be extended by up to two further months. We will notify you of any extension and explain the reason.

There is normally no charge. A reasonable fee may be charged, or a request may be refused, where permitted by law because it is manifestly unfounded or excessive.

Requests Involving Client Data

Where Auxilia processes personal data solely on behalf of a client, the client may be responsible for responding to your request.

We will direct the request to the appropriate client or assist the client where required.

Making a Complaint

Please contact us first if you are concerned about how we have used your personal data. We will review the matter and seek to resolve it appropriately.

You also have the right to make a complaint to the Irish Data Protection Commission. Current guidance and complaint information are available through the Data Protection Commission’s official website.
